ai regulation moratorium in 2026: what the enforced record shows while Congress stalls

A moratorium would freeze new state AI statutes. It would not touch the fines, bans and court orders already landing on AI systems under laws that predate the debate.

Buyers keep telling us they are waiting for the AI rules to land before they commit to a system. The waiting is the mistake. While Congress argues about whether to freeze state AI laws, regulators and courts have already fined, banned, and certified cases against real AI deployments, using law that has been on the books for years.

The moratorium fight has been loud, and it keeps ending the same way. On July 1, 2025 the Senate voted 99-1 to strike a 10-year ban on state AI regulation from the One Big Beautiful Bill Act, with only one senator opposed (Reason). The bill President Trump signed on July 4 carried no moratorium. A second attempt, rumored for the 2026 National Defense Authorization Act, was left out of the released text in December 2025 (StateScoop).

So the headline number is this: two attempts, zero moratoriums enacted, and a Clearview fine of 30.5 million euros standing the whole time (Dutch DPA).

What an AI regulation moratorium is

An AI regulation moratorium is a federal measure that would bar states from enforcing their own AI-specific laws for a set period, ten years in the failed 2025 version. It freezes new state statutes; it does not repeal the general-purpose laws already applied to AI systems.

That distinction is the whole point, and it is the one the coverage skips.

Is AI regulation in the big beautiful bill?

It was, and then it was not. A 10-year moratorium on state AI laws rode the One Big Beautiful Bill Act through committee, and the Senate removed it on July 1, 2025 in a 99-1 vote after a bipartisan amendment (Markey).

The signed law contains no AI moratorium. Anyone citing the bill as the reason AI is or is not regulated is citing a provision that was cut before passage.

Would a moratorium leave AI unregulated?

No, and this is where the debate misleads. A moratorium aims at new state AI statutes. Every enforcement action worth naming so far ran on law that is not AI-specific and would survive a freeze untouched.

Data-protection law did the work against Clearview. Consumer-protection law did it against an AI-storefront scheme. Age-discrimination and fair-housing law did it against AI hiring and tenant-screening tools. None of those needed a state AI statute, so none of them stops if state AI statutes are paused.

The proof: what already landed under existing law

TIN verifies outcomes against the public record. Four we have checked show the enforced record a moratorium does not reach.

  • Clearview AI, 30.5 million euros. The Dutch Data Protection Authority fined Clearview 30.5 million euros for building an illegal facial-recognition database of more than 30 billion scraped images, under the GDPR, not any AI law.   • Ascend Ecom, 25 million dollars and a permanent ban. In an FTC action, the court entered a 25 million dollar judgment on August 11, 2025 and permanently banned the operators from marketing business opportunities, after they pitched an e-commerce storefront as “powered by artificial intelligence.” The tool was the FTC Act.   • Mobley v. Workday, nationwide collective certified. On May 16, 2025 a federal judge granted preliminary certification of a nationwide ADEA collective action over Workday’s AI applicant-screening, letting notice issue to applicants aged 40 and older. It is a procedural ruling, not a merits finding, and Workday denies the claims. The statute is the Age Discrimination in Employment Act. See the Workday case file.

  • Louis v. SafeRent, 2.275 million dollar settlement. A federal court granted final approval on November 20, 2024 of a class settlement capped at 2,275,000 dollars that also bars SafeRent from scoring housing-voucher applicants for five years. The only column already producing fines and court orders is the last one, and it is the one a moratorium was never written to touch.

The bottom line

The moratorium debate trains everyone to watch legislation that has not passed, while the enforcement that has already happened runs on law nobody is voting on. If you are deciding whether to deploy an AI system, the settled question is not what Congress does next. It is whether your system would survive the laws that already fined Clearview and banned Ascend.

The transferable rule: regulate your own AI to the enforced record, not the proposed one. The enforced record is the only version that has ever collected.
