# Best AI agent for customer service in 2026: rank by evidence, not features

By Maneesh Behera, Head of AI Deployment. Published 2026-10-03. The Internet Ninja, analysis.

> Every list of the best AI agent for customer service ranks features. Three deployments with public figures, two chatbot liability rulings and one regulator fine say the better test is what evidence the agent leaves behind, and who answers for it.

## Case files this argument rests on

- [Notion and Decagon: an AI support agent, 34% faster resolution and 2x deflection](https://theinternetninja.com/stories/decagon-notion-ai-cx/)
- [Octopus Energy's 'Magic Ink': AI that drafts support emails, with no job cuts](https://theinternetninja.com/stories/octopus-energy-kraken-ai-support/)

- [A German court says you own what your chatbot says: OLG Hamm holds a clinic liable when its AI invented specialist titles](https://theinternetninja.com/stories/olg-hamm-aesthetify-ai-chatbot-fabricated-facharzt-titles-uwg-liability-cease-desist-2026/)
- [Hungary's NAIH halts a bank's AI emotion analysis of call recordings, HUF 250,000,000 fine (2022)](https://theinternetninja.com/stories/hungarian-naih-budapest-bank-250m-huf-fine-unlawful-ai-emotion-voice-analysis-2022/)

Search for the best AI agent for customer service and you get feature grids. Languages supported, integrations, a price per resolution, a star rating. None of it tells you whether the agent worked for anyone.

That gap matters because the buyer carries the risk, not the vendor. When the agent answers wrong, the courts have so far been clear about whose answer it was.

So this guide does not rank vendors. It ranks the evidence. TIN holds three customer service deployments with published figures and three adjudicated records on customer-facing AI: two rulings on what a chatbot said and one regulator fine over what an AI did with recorded calls, and together they give a better selection test than any feature grid.

## What the best AI agent for customer service means

The best AI agent for customer service is the one that resolves real support volume with results you can trace to a named customer, hands the hard cases to a person, and is constrained from saying things the company would then have to honour.

That definition has three parts, and most vendor lists test none of them.

## Is there a public ranking of AI customer service agents?

No, there is no independent public ranking of AI customer service agents by measured outcomes. The figures that exist are published one deployment at a time, almost always by the vendor or the customer, and they use different metrics, so they cannot be lined up against each other.

Notion reports a <span class="kpi">34%</span> improvement in ticket resolution time and a <span class="kpi">2x</span> increase in deflection on Decagon ([source](https://decagon.ai/case-studies/notion)). Klarna reported <span class="kpi">2.3 million</span> conversations, two-thirds of its customer service chats, in its assistant's first month ([source](https://www.klarna.com/international/press/klarna-ai-assistant-handles-two-thirds-of-customer-service-chats-in-its-first-month/)). One is a speed gain, the other a share of volume. Neither is a rank.

A head-to-head comparison would need one method applied across vendors before any data is collected. That is a study, not a listicle, and nobody has published one.

## Which AI customer service agent examples have published results?

Three AI customer service agent examples carry figures that survived a check against the public record, and each one teaches a different thing about what to buy.

**Notion on Decagon: the named executive.** Every figure comes from Decagon's own case study, including a <span class="kpi">3.4%</span> ask-for-human rate ([source](https://decagon.ai/case-studies/notion)). What makes it usable is that Notion's Global Head of Customer Experience is quoted on the record, so the numbers have someone who could refute them.

**Octopus Energy's Magic Ink: the human on the send button.** Kraken's case study says around <span class="kpi">35%</span> of customer emails were written with the tool's help, with satisfaction around <span class="kpi">70%</span> ([source](https://www.techuk.org/resource/case-study-kraken-tech-s-generative-ai-tool-for-customer-service.html)). A person reviews and sends every reply. The CEO said it was "unlikely to lead to job cuts" ([source](https://www.cityam.com/ai-doing-the-work-of-over-200-people-at-octopus-chief-executive-says/)), and in 2024 Octopus announced <span class="kpi">4,000</span> new jobs ([source](https://octopus.energy/press/octopus-energy-4000-jobs/)).

**Klarna: the fastest headline and the walk-back.** Klarna said resolution time fell from <span class="kpi">11 mins</span> to under <span class="kpi">2 mins</span> ([source](https://www.klarna.com/international/press/klarna-ai-assistant-handles-two-thirds-of-customer-service-chats-in-its-first-month/)). In 2025 its CEO said cost had been "a too predominant evaluation factor" and that the result was "lower quality" ([source](https://www.customerexperiencedive.com/news/klarna-reinvests-human-talent-ai-customer-service-buy-now-pay-later/747586/)).

The most autonomous deployment produced the most impressive first month and the only public reversal. That is the pattern a buyer should price in.

## Who is liable when an AI customer service agent is wrong?

The company that deploys the AI customer service agent is liable for what it says. Two courts in two legal systems have now rejected the argument that a chatbot is a separate actor.

In Moffatt v. Air Canada, the British Columbia Civil Resolution Tribunal ordered the airline to pay <span class="kpi">C$812.02</span> after its website chatbot described a retroactive bereavement refund that the airline's own policy did not offer ([source](https://www.canlii.org/en/bc/bccrt/doc/2024/2024bccrt149/2024bccrt149.html)). The tribunal wrote: "It makes no difference whether the information comes from a static page or a chatbot" ([source](https://www.canlii.org/en/bc/bccrt/doc/2024/2024bccrt149/2024bccrt149.html)).

On 12 May 2026, the Higher Regional Court of Hamm held that a clinic's chatbot answers were the clinic's own commercial acts, after the bot told visitors its directors held specialist titles they did not hold ([source](https://nrwe.justiz.nrw.de/olgs/hamm/j2026/4_UKl_3_25_Urteil_20260512.html)). It ordered a cease and desist under a fine of up to <span class="kpi">250,000 euros</span> per violation ([source](https://nrwe.justiz.nrw.de/olgs/hamm/j2026/4_UKl_3_25_Urteil_20260512.html)). The ruling is under appeal.

The third record is about what the agent does with the call, not what it says. Hungary's data protection authority fined a bank <span class="kpi">HUF 250,000,000</span> for running AI emotion analysis over recorded customer service calls without a lawful basis ([source](https://www.edpb.europa.eu/news/national-news/2022/data-protection-issues-arising-connection-use-artificial-intelligence_en)).

## The proof

Each claim above rests on a TIN case file, checked against primary and independent sources before it went live. Read them for the caveats, which are the useful part.

- [Notion and Decagon](https://theinternetninja.com/stories/decagon-notion-ai-cx/): single vendor source, anchored to a named and quoted customer executive.
- [Octopus Energy's Magic Ink](https://theinternetninja.com/stories/octopus-energy-kraken-ai-support/): CEO statements relayed by three outlets, with a satisfaction figure that moves between statements, shown rather than merged.
- [Klarna's AI assistant](https://theinternetninja.com/stories/klarna-ai-assistant-customer-service/): every 2024 efficiency figure originates with Klarna; the 2025 reversal is the independent counterweight.
- [Moffatt v. Air Canada](https://theinternetninja.com/stories/air-canada-chatbot-bereavement-misinfo-tribunal-orders-812-cad-negligent-misrepresentation-2024/): the signed tribunal decision, corroborated by two newsrooms.
- [OLG Hamm on a clinic's chatbot](https://theinternetninja.com/stories/olg-hamm-aesthetify-ai-chatbot-fabricated-facharzt-titles-uwg-liability-cease-desist-2026/): the full-text judgment, not yet final.
- [Hungary's NAIH and the bank's emotion AI](https://theinternetninja.com/stories/hungarian-naih-budapest-bank-250m-huf-fine-unlawful-ai-emotion-voice-analysis-2022/): the authority's own decision text.

## How the six records compare

| Record | What the agent did | Headline figure | Who published it | Human in the loop |
|---|---|---|---|---|
| Notion / Decagon | Deflects and routes tickets | 34% faster resolution | Vendor, customer named | 3.4% ask for a human |
| Octopus / Magic Ink | Drafts email replies | ~35% of emails | Vendor and CEO | Every reply |
| Klarna | Handles chats end to end | Two-thirds of chats | Klarna | Rebuilt in 2025 |
| Air Canada | Answered policy questions | C$812.02 award | Tribunal | None on the answer |
| OLG Hamm clinic | Answered and booked | Up to 250,000 euros per violation | Court | None on the answer |
| Budapest Bank | Scored caller emotion | HUF 250,000,000 fine | Regulator | Staff acted on scores |

## How to choose an AI customer service agent

Choose an AI customer service agent by asking each vendor for three things the feature grid does not show.

First, a named customer with a published figure and a person on record behind it. A logo wall is not evidence. Second, the handoff design: what share of contacts reach a human, and who decides. Third, the guardrail: what stops the agent from stating a policy, a price or a qualification your company would then owe.

The obvious reading of the Klarna case is that autonomy is the goal and Klarna simply moved too fast. The record says something narrower. The deployments still standing without a public reversal keep a person accountable for the hard cases, and the rulings make that person your legal exposure either way.

## The bottom line

The best AI agent for customer service is not a product name. It is a deployment you could defend in front of a tribunal, with a figure someone named would stand behind. Buy on evidence and on the handoff, then assume every sentence the agent writes is a sentence your company wrote, because so far every court asked has said exactly that.

## Questions

**How do you choose the best AI agent for customer service?**

The best AI agent for customer service is the one whose results you can trace to a named customer and a figure someone could refute. No public record ranks vendors head to head, so judge a shortlist on published outcomes, the human handoff design, and how the agent is constrained from making claims the company would have to honour.

**Are companies liable for what their AI customer service agent says?**

Yes, on the record so far a company is liable for what its AI customer service agent says. A Canadian tribunal ordered Air Canada to pay C$812.02 over its chatbot's invented refund policy, and the Higher Regional Court of Hamm held in May 2026 that a clinic's chatbot answers were the clinic's own commercial acts.

**What are real examples of an AI customer service agent with published results?**

Real examples with published results include Notion on Decagon (34% faster ticket resolution, 2x deflection), Octopus Energy's Magic Ink (around 35% of emails drafted with it, a human sending each one) and Klarna (two-thirds of chats in its first month, later walked back on quality).
